The company is the owner of the Touriny mobile application, available for Android and iOS devices, as well as the associated information website.

2. Object

This Legal Notice regulates access, navigation and use of the www.touriny.com website and the Touriny mobile application.

Access or use of any of these services implies full and unreserved acceptance of all the provisions contained in this document.

3. Activity

Touriny is a digital platform aimed at offering self-guided tourist tours.

Through the application users can:

• Create an account.

• Access through Google, Facebook or email.

• Check available destinations.

• Select tourist routes.

• Browse using geolocation.

• Receive directions using Google Maps technology.

• Listen to audio explanations at each point of interest.

• Consult cultural and historical information prepared by Touriny.

• Purchase version Touriny Pro to remove advertising.

4. User condition

The use of the website or application confers the status of User.

The User agrees to use all services in accordance with:

• current legislation;

• good faith;

• public order;

• the present conditions.

Any fraudulent, illicit or harmful use of Touriny or third parties is prohibited.

5. Intellectual and Industrial Property

All content available on Touriny is original and exclusive property of TOURINY S.L., unless expressly indicated otherwise.

This includes, but is not limited to:

• tourist tours;

• the structure of the routes;

• the selection of points of interest;

• descriptive texts;

• historical explanations;

• the icons;

• graphic design;

• visual identity;

• the Touriny mark;

• the logo;

• the software;

• the database;

• the source code developed by Touriny;

• the mobile application;

• the website.

All this material is protected by Spanish, European and international legislation on intellectual and industrial property.

All rights are reserved.

This protection includes both the content currently published and those that are incorporated in future updates.

6. Copyright

Touriny is the author and owner of all exploitation rights over the content created by the company.

Consequently, it is expressly prohibited:

• copy the contents;

• massively download information;

• record the audios for redistribution;

• reproduce the texts;

• translate the contents;

• sell the routes;

• reuse tours;

• publish the photographs;

• play the audios on social networks;

• use the content on YouTube channels;

• use the content to train Artificial Intelligence models;

• automatically extract information using robots or scraping tools;

• generate derived databases;

• resell the contents;

• create similar applications using the materials from Touriny;

• use any content for commercial or lucrative purposes without express written authorization from TOURINY S.L.

The contracting or use of the application does not imply in any case the transfer of intellectual property rights.

The user is only granted a personal, limited, revocable and non-exclusive license to view the content during normal use of the application.

• curiosities;

• recommendations;

• educational content.

Audiovisual content

Also protected are:

• narratives;

• locutions;

• hyphens;

• audio guides;

• recordings;

• original music, when it exists;

• sound effects;

• photographs;

• illustrations;

• infographics;

• videos;

• graphic material.

Corporate identity

They are also protected:

• logo

• brand

• trade name

• distinctive elements.

8. Authorship of the routes

The sightseeing tours offered by Touriny constitute an original intellectual creation developed by TOURINY S.L.

Originality does not reside solely in the existence of monuments or public places, but in the creative work carried out by Touriny to:

• select points of interest;

• determine the route;

• set the order of visit;

• design the user experience;

• elaborate the historical narrative;

• research information;

• write the texts;

• produce the audios;

• integrate all elements into a unique tourist experience.

Consequently, the total or partial reproduction of a tour may constitute an infringement of intellectual property rights when it reproduces the creative structure developed by TOURINY S.L.

9. License granted to the user

The user receives only a limited license to:

• view the contents;

• listen to the audios;

• use tours;

• Enjoy the application according to its purpose.

This license is:

• staff;

• revocable;

• non-exclusive;

• non-transferable;

• without the possibility of sublicensing.

There is no transfer of intellectual property rights.

10. Permitted use

The user may use Touriny exclusively for personal use.

You will not be able to:

• market the content;

• distribute it;

• rent it;

• sublicense it;

• modify it;

• play it;

• decompile the application;

• perform reverse engineering;

• remove copyright notices;

• create derivative works.

11. Expressly prohibited uses

It is prohibited, without prior written authorization from TOURINY S.L.:

Regarding the texts

• play;

• translate;

• modify;

• resume;

• post;

• sell;

• distribute;

• reuse.

Regarding the audios

• discharge;

• engrave;

• copy;

• sync with videos;

• cast;

• retransmit;

• market;

• transform.

Regarding the images

• download for commercial use;

• sell;

• modify;

• remove watermarks;

• use in campaigns;

• include in posts;

• resell.

Regarding the routes

• copy routes;

• play itineraries;

• use the same sequence of points;

• market equivalent tours obtained from Touriny;

• publish derived routes.

Regarding the application

• decompile;

• perform reverse engineering;

• modify the software;

• copy the code;

• reproduce protected functionalities.

12. Protection of audiovisual content

The tourist audios have been created specifically by TOURINY S.L.

The texts, narrations, scripts, images and multimedia material constitute works protected by copyright.

It is expressly prohibited:

• download the audios;

• copy them;

• convert them to other formats;

• publish them;

• sync them with videos;

• issue them publicly;

• sell them;

• use them in courses;

• incorporate them into other applications;

• use them to train Artificial Intelligence systems.

Any use other than authorized personal use will require express written authorization from TOURINY S.L.

13. Prohibition of commercial use

No content may be used for purposes:

• commercials;

• advertising;

• editorials;

• for-profit teachers;

• tourist;

• business;

• promotional;

• lucrative.

Professional use will require express authorization from TOURINY S.L.

14. Protection against Artificial Intelligence

TOURINY S.L. expressly expresses its reservation of rights regarding the use of all contents of Touriny for text and data mining activities (Text and Data Mining), training of artificial intelligence models, machine learning (Machine Learning), generative models, conversational assistants and any other automated processing technology.

It is expressly prohibited:

• use the texts to train AI models;

• use the audios to train speech synthesis models;

• use images to train generative models;

• use routes to train recommendation systems;

• generate derived databases;

• feed language models with any content of Touriny;

• use extraction robots;

• perform scraping;

• massively index information;

• use unauthorized APIs;

• create products based on the contents of Touriny.

This reservation of rights is made under the protection of current regulations on intellectual property and the applicable provisions on text and data mining.

15. Protection against scraping

Any automated extraction of information through:

• bots;

• spiders;

• crawlers;

• scrapers;

• automated software;

• artificial intelligence;

• Unauthorized APIs;

• massive copy systems.

Violation of this prohibition may give rise to legal action.

16. Database Protection

The compilation, organization and structure of the information contained in Touriny constitutes a database protected by intellectual property regulations and, where applicable, by the sui generis rights recognized to database manufacturers.

The extraction or reuse of all or a substantial part of said database is prohibited without prior written authorization from TOURINY S.L.

17. Use of geolocation

The application uses the location of the device to guide the user during tourist tours.

Geolocation will only be used when the user grants the corresponding permission from their device.

The user may revoke this permission at any time from their phone settings.

Disabling location may prevent certain features from working properly.

18. Responsibility

Touriny makes a significant effort to keep the information up to date.

However, it does not guarantee:

• that all monuments remain open;

• that certain streets are not closed;

• that works exist;

• that certain accesses remain available;

• that the hours of museums or establishments do not change.

The user accepts that they use the tours at their own risk.

Touriny will not be responsible for:

• accidents;

• falls;

• losses;

• thefts;

• personal injury;

• material damage;

• fines;

• sanctions;

• incidents derived from traffic;

• incidents caused by third parties.

19. Third party services

The application uses technological services provided by third parties, including:

• Firebase.

• Google Maps Platform.

• Google Authentication.

• Facebook Login.

• Google AdMob.

• Matomo Analytics.

• Google Tag Manager.

Each of these services has its own conditions of use and privacy policies.

Touriny does not control these websites nor is it responsible for the content hosted on them.

21. Social networks

Touriny has official profiles at:

• Facebook.

• Instagram.

• TikTok.

These networks are exclusively informative and informative.

The relationships between users and said platforms are subject to the particular conditions established by each of them.

22. Security

Touriny adopts technical and organizational measures aimed at protecting user information against unauthorized access, alteration or loss.

However, no system connected to the Internet can guarantee absolute security.

23. Modifications

TOURINY S.L. may modify this Legal Notice when necessary to adapt it to regulatory, technological or functional changes.

The modifications will take effect from their publication.

29. Applicable legislation and jurisdiction

This Legal Notice is governed by Spanish legislation.

Any controversy will be submitted to the Courts and Tribunals that are competent in accordance with current regulations, unless a legal provision establishes another mandatory jurisdiction for consumers or users.
